Custom Homes: Why Fixed-Price Contracts Protect Your Budget

Custom Homes: Why Fixed-Price Contracts Protect Your Budget

A fixed-price contract protects your budget because the price agreed at signing cannot change due to material costs, labour rates, or site conditions discovered after the fact. It shifts the financial risk of a custom home build away from the homeowner and onto the builder, provided the price was set properly in the first place.

What Are the Benefits of a Fixed-Price Building Contract?

  • The contract price is locked in once, and doesn’t move regardless of market changes during construction
  • Variations can only occur if you change the scope, not because the builder underquoted at tender stage
  • Finance approvals and cash flow planning become far more reliable with a known total cost
  • It removes the ongoing anxiety of wondering whether the next invoice will be higher than expected
  • It holds the builder accountable to their own estimate, rather than passing risk to the client

Does "Fixed-Price" Always Mean What It Sounds Like?

Not automatically. Some contracts marketed as fixed-price still include cost-escalation clauses for materials or labour, or vague provisional allowances for site works that get “confirmed” once construction starts. A genuinely fixed-price contract sets its number only after a proper soil test, site survey, and finalised design, so nothing meaningful is left unconfirmed. If a builder offers a fixed price before any of that assessment work has happened, the number is closer to a placeholder than a real commitment.

What's the Risk of Signing a Vague Fixed-Price Contract?

The risk is the same one fixed-price contracts are meant to solve: budget blowouts. Victoria’s building sector has seen a wave of cost disputes in recent years, often tracing back to underquoting at the tender stage to win the job, with the real cost only emerging through variations once construction is underway. A vague fixed-price contract can leave you facing exactly the surprises you thought you’d avoided, just with less recourse because you already signed.

Can You Get a Fixed Price Without a Full Site Assessment First?

Technically, yes, but it isn’t advisable. A quote issued before a soil test or site survey is an estimate dressed up as a fixed price. Reactive clay soils, for example, can add thousands to footing costs once properly tested, and that cost has to land somewhere; either the builder absorbs it (unlikely) or it appears as a variation later. The only way to get a fixed price that genuinely holds is to complete the assessment work first, then lock in the number.

How Fixed-Price Contracts Compare to Cost-Plus Arrangements

Cost-plus contracts, common with some custom builders, charge the actual cost of materials and labour plus a builder’s margin, with no upper limit agreed at signing. This can suit highly bespoke, one-off architectural projects where scope genuinely can’t be fixed in advance, but for a standard or semi-custom home it shifts nearly all financial risk onto the homeowner. A fixed-price contract, by contrast, puts that risk on the builder once the price is set, which is exactly why it’s become the preferred structure for homeowners who need budget certainty from the outset. Comparing the two structures side by side, for the same design and site, usually makes clear which one actually protects the person paying for the build.

What to Do Before You Sign

Ask your builder directly whether the price was set before or after a soil test, what allowances are included for kitchens, bathrooms, and flooring, and under what specific conditions the price can change. Check their licence status with the Building and Plumbing Commission Victoria, and confirm whether they’re a member of an industry body such as the Association of Professional Builders. It’s also worth asking to see a sample contract before committing to a design, so you understand exactly how variations are defined and approved well before you’re in a position where you feel pressure to accept one.
